Welcome to APEX Nutrition. These Terms and Conditions govern your use of our website and the purchase of any products from us. By accessing our site or creating an account, you agree to be bound by these terms.

1. General Conditions

• Service Area: We currently only offer delivery services within the city limits of Addis Ababa, Ethiopia.

• Eligibility: By using this site, you confirm you are at least 18 years of age or are accessing the site under the supervision of a parent or guardian.

2. Products and Health Disclaimer

• Not Medical Advice: The products sold on this website are sports nutrition supplements and are not intended to diagnose, treat, cure, or prevent any disease. Always consult with a healthcare professional before starting any new supplement regimen.

• Accuracy: We strive to ensure that all product descriptions and images are accurate; however, actual packaging and materials may vary.

3. Orders and Pricing

• Contract Formation: Your order is an offer to buy. A contract is only formed when we call you to confirm the delivery and the rider arrives at your location.

• Pricing: All prices are listed in Ethiopian Birr (ETB). We reserve the right to change prices at any time without prior notice.

4. Payment and Delivery

• Payment on Delivery: We operate on a pay-on-delivery basis. Payment must be made at the time of receipt via Telebirr, Bank of Abyssinia transfer, or Cash.

• Inspection: You have the right to inspect the product seals upon delivery. Once the seal is broken or the rider has left after payment, the sale is considered final.

5. Membership and Reward Credits

• Nature of Credits: Store credits (e.g., the 100 Birr per order or 200 Birr referral) are non-refundable, non-transferable, and cannot be exchanged for cash.

• Usage: Credits can only be used as a discount toward future purchases on APEX Nutrition.

• Expiration: We reserve the right to expire credits if an account has been inactive for more than 12 consecutive months.

6. Personal Data and Privacy

In accordance with the Ethiopian Personal Data Protection Proclamation, we collect your information (Name, Phone, Location) solely for:

• Processing your orders.

• Providing live rider tracking.

• Managing your rewards dashboard. We do not share your data with third parties except for the delivery personnel required to fulfill your order.

7. Intellectual Property

All content on this site, including text, graphics, logos, and images, is the property of APEX Nutrition. Any unauthorized use or reproduction is strictly prohibited under Ethiopian intellectual property laws.

8. Limitation of Liability

APEX Nutrition shall not be liable for any indirect, incidental, or consequential damages resulting from the use or misuse of our products or our website.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the Federal Democratic Republic of Ethiopia. Any disputes shall be settled in the competent courts of Addis Ababa.
